This is the homepage for the Peek, et al v.Microsoft Corp., No. CV-06-2612 case.This case is pending in the Circuit Court of Pulaski County, Arkansas. ALL INQUIRIES SHOULD BE DIRECTED TO THE SETTLEMENT ADMINISTRATOR AT 1-800-572-0455 Case Background Plaintiff alleges that Microsoft unlawfully used anticompetitive means to maintain a monopoly in markets for certain software, and that as a result, it overcharged Arkansas consumers who licensed its MS-DOS, Windows, Word, Excel and Office software. Microsoft denies plaintiff's allegations and believes that it developed and sold high quality and innovative software products at fair and reasonable prices. The parties settled the case and on September 7,2006 the Court conditionally certified a Settlement Class (defined in the notice) and approved a preliminary Settlement Agreement, signed by Microsoft Corporation and Class Counsel. The Court will decide whether to grant final approval of the Settlement at a hearing on March 6, 2007.
Settlement If you, between January 1, 1998 and December 31, 2004, resided in Arkansas and licensed, directly or indirectly,certain Microsoft software, or purchased a personal computer with certain Microsoft software installed on it for use in Arkansas and not for resale, you may be eligible as a Class Member and entitled to benefits under the proposed class action settlement. To be a Class Member, a person or entity must have purchased in the United States a Microsoft Operating System and/or Microsoft Application for use in Arkansas, in the United States, between January 1, 1998 and December 31, 2004. Licenses for re-sale or re-licensing are not eligible for the Settlement. If you are a member of the class, you are entitled to receive Settlement Benefits. Microsoft will provide half the value of the unclaimed Settlement Benefits to help Arkansas's public schools - those with at least 50% of their students qualifying for the federal free and reduced-price school lunch programs. Arkansas's public schools will receive vouchers to use on a wide variety of computer hardware, software and professional development services.In addition, one half of the value of vouchers issued to Class Members but not redeemed will be distributed to the Arkansas Department of Education.
