Corrugated Stainless Steel Tubing Settlement. Throughout this website,
Corrugated Stainless Steel Tubing is referred to simply as “CSST.”
If you intend to redeem the voucher you received as part
of the CSST Settlement, you must return your completed Questionnaire postmarked
no later than March 5, 2008. Should you have any questions
regarding installation of Lightning Protection Systems and Bonding and

The claim filing deadline is closed effective September 5, 2007. Claims
sent after September 5, 2007 will not be accepted.
Potential Class Members who installed a Lightning Protection
System before September 5, 2006 but without submitting a claim in the CSST
Settlement may be eligible for monetary recovery under the Settlement through a
special arrangement proposed by Class Counsel and to which Counsel for the
Defendants’ have consented. Recovery under this proposed arrangement is limited
and Class Counsel, the Defendants or their Counsel may repeal the arrangement
at any time.
Potential Class Members are eligible for this special provision if they meet
ALL of the following requirements:

Potential Class Member engaged with a contractor for the installation of a
Lightning Protection System; AND
-
The LPS was installed prior to September 5, 2006; AND
-
The LPS was installed in accordance with NFPA 780 or UL standards; AND
-
The Potential Class Member paid actual out-of-pocket expenses for the
installation of an LPS.
To prove eligibility, Potential Class Members must complete an
Installed
LPS Claim Form. This form must be requested from the Settlement
Administrator by calling 1 (800) 420-2916.
Please note: All claims must be
filed by September 5, 2007.
This settlement has been approved in the Clark County Circuit
Court of Arkansas. The Defendants in the case, Titeflex Corporation, Ward
Manufacturing, Inc., OmegaFlex, Inc. and Parker Hannifin Corp., are referred to
throughout as “Settling Defendants.” The persons who filed the lawsuit are
called “Plaintiffs.” The Effective Date of the Settlement is March 5, 2007.
The Settlement is final. As such, the Settlement Administrator
anticipates mailing Payment Vouchers to eligible claimants beginning in early
to mid April along with instructions on how to proceed. If you have filed
a complete Claim, your Payment Voucher and detailed information regarding the
remainder of the process will be sent. If your claim is incomplete, a
letter requesting additional information will be sent. If the Settlement
Administrator does not receive the required Claim information, you will not be
able to receive any benefits from this Settlement.

September 5, 2007.

A nationwide class action has been filed on behalf of any and
all persons and/or entities who own structures in the United States in which
CSST manufactured by Titeflex, Ward, OmegaFlex or Parker Hannifin was installed
as of September 5, 2006. Plaintiffs allege that CSST poses an unreasonable risk
of fire due to lightning strikes. The Settling Defendants deny these
allegations and assert that their CSST is safe if properly installed in
accordance with local codes and the manufacturers’ instructions. The Proposed
Settlement is a compromise of disputed claims and does not mean the Settling
Defendants are liable.
